🟡 Mumbai’s Babubhai Bhavanji Flags ‘Betrayal of Mandate’

Babubhai Bhavanji, a resident of Hindu Colony, Dadar East, Mumbai, has formally written to the Law Commission of India, raising serious concerns over the growing trend of political defections and its impact on Indian democracy.

In his letter, Bhavanji highlighted how elected representatives switching parties after elections undermines the trust of voters and weakens the democratic framework. He stressed that voters cast their ballots based on party ideology and promises, but post-election defections often prioritize personal or political gains over public mandate.

🟡 Anti-Defection Law Under Scrutiny

Bhavanji has questioned the effectiveness of the current Anti-Defection Law under the Tenth Schedule of the Constitution, stating that it has failed to curb unethical political shifts. According to him, existing loopholes allow mass defections, diluting accountability and transparency in governance.

🟡 Three Key Reforms Proposed

1. Immediate Disqualification

Bhavanji has proposed that any elected representative—MLA or MP—who leaves the party on whose ticket they were elected should face automatic and immediate disqualification, regardless of the number of defectors involved.

2. Five-Year Election Ban

He further suggested that defecting leaders should be barred from contesting elections for at least five years and should also be restricted from holding any ministerial or government position during this period.

3. Right to Recall for Voters

In a significant demand, Bhavanji has called for the implementation of the ‘Right to Recall’, allowing voters to remove elected representatives before the end of their term through a structured legal process such as a referendum or signature campaign.

🟡 Growing Concern Over Democratic Integrity

The letter warns that continued political defections could erode public trust in the democratic system. Bhavanji emphasized that if elected leaders continue to switch allegiances without consequences, citizens may lose faith in elections and governance.

🟡 Call for Legislative Action

Bhavanji has appealed to the Law Commission, Government of India, and Parliament to take immediate steps and introduce necessary amendments in the upcoming Parliament session. His demand reflects a broader public sentiment seeking accountability, transparency, and stronger voter rights in India’s political system.
